Seamsdress Terms of Service

Effective Date: August 15th, 2025
 Applies to: All Users of the Platform, including but not limited to Customers, Service Providers, Brands, and Community Participants
Platform: Seamsdress ("Company", “we”, “our”, or “us")

This User Participation Agreement ("Agreement") governs your access to and use of the Seamsdress platform ("Seamsdress," "we," "our," "us"), including our website, mobile applications, administrative dashboard, Application Programming Interface (API), and all related services and tools.

By accessing, browsing, registering for an account, or otherwise using any part of Seamsdress—including but not limited to signing up, submitting a project, receiving payments, or integrating our services via API or our apps—you acknowledge that you have read, understood, and agree to be legally bound by these comprehensive terms, as well as our Privacy Policy. If you do not agree to these terms, you may not access or use the Seamsdress platform.

By creating an account or using the Seamsdress platform—including bidding tools, project submissions, messaging features, groups, forums, community feeds, and direct messaging—you (“User”) agree to be bound by this  Terms of Service,  and Privacy Policy. You agree to comply with all applicable federal, state, and local laws governing online commerce, communications, intellectual property, privacy, and user conduct.

You acknowledge that Seamsdress is a national platform based in the United States, and agree that this Agreement governs your use regardless of your physical location. You further agree to waive the applicability of any conflicting or broader state-specific consumer, business, or internet commerce laws unless expressly required by federal law.

Eligibility

You must be at least 18 years of age and legally capable of entering into this agreement.

Platform Purpose & Scope

Seamsdress operates as a sophisticated software platform designed to facilitate connections and streamline operations within the custom clothing and garment production industry. Our core functionalities enable:
 

• Customers: Individuals seeking clothing-related services (e.g., alterations, custom garments, manufacturing) to efficiently find, communicate with, and securely pay qualified service providers.

• Service Providers: Tailors, garment makers, fashion designers, and manufacturers to manage their projects, offer their specialized services, bid on prospective jobs, and receive secure payments for their work.

• Brands: Fashion brands to connect with expert partners for collection production and management.

• Retailers: Fashion retailers to enhance customer fit, connect users with local tailoring services, and reduce product return rates via app or API integration.

Important Disclaimer: Seamsdress solely provides the technological platform for these interactions. We do not directly provide any tailoring or manufacturing services. All work is performed by third-party providers. Seamsdress is not a party to any service contracts formed between users. 
 
Independent Contractor Status

Service Providers and Brands are independent contractors. Nothing in this Agreement shall create a partnership, employment, or agency relationship. You are solely responsible for taxes, service delivery, and legal compliance.

No Platform Circumvention, Cross-Selling, or Competing Services

Seamsdress is not to be used for off-platform solicitation, circumvention, or indirect selling. Users may not replicate, compete with, or undermine Seamsdress’s business model through any form of platform interaction.

You may not:
 

• Solicit or accept payments off-platform
   

• Promote or offer similar or competing services via chat, DM, groups, forums, or your profile
   

• Share links, contact info, or social handles to divert users off-platform
   

• Build off-platform businesses using relationships or exposure from Seamsdress
   

Violating this agreement—including this section—will result in immediate account termination, removal of content, and feature restrictions. In serious cases, legal action may be pursued.

No Guarantee of Engagement or Outcome

Seamsdress does not guarantee:
 

• Project assignments or matches

• Quality or outcome of any service
   

Users assume all risks when engaging with others.
 
User Types & Responsibilities

Seamsdress categorizes its users to define specific roles, rights, and responsibilities:
 

• Customers

  • Project Submission & Payment: Customers may post projects, request bids, accept offers, and pay securely through Stripe.

  • Communication & Approval: Customers are responsible for communicating needs clearly and confirming final work meets expectations before approving payment release.

  • Use of Sizing Tools & Liability: Customers may utilize Seamsdress sizing tools (including the Seamsdress Apps and API) to pull saved measurements and get smart size recommendations. However, Seamsdress does not guarantee the accuracy of size recommendations or tailoring outcomes from these tools, and customers assume all liability related to the delivery and outcome of services.

  • Dispute Resolution: In the event of a dispute, customers agree to utilize Seamsdress's internal dispute resolution mechanisms where applicable before pursuing external remedies.

• Service Providers (Tailors, Garment Makers, Designers, Manufacturers)

  • Profile Maintenance: Service providers must maintain a complete, accurate profile before bidding or accepting work.

  • Service Quality & Professionalism: Service providers are responsible for providing quality service, regular updates, and professional communication.

  • Compliance & Consequences: Service providers can be removed or suspended if there are service complaints, policy violations, or quality concerns.

• Brands

  • Connecting with Production Partners: Seamsdress helps brands find and manage the expert partners needed to bring their collections to life. Whether producing couture, menswear, bridalwear, or small-batch ready-to-wear, our platform connects brands with trusted tailors, garment makers, and manufacturers to scale production with confidence and quality.

  • Project Bidding System: Instead of searching for the right partner, brands can let them find you. Our project bidding system draws from a nationwide directory of tailors, garment makers, and manufacturers—who respond to your project with quotes, timelines, and capabilities.

  • Diverse Project Needs: Whether needing alterations, sampling, or full production, brands can easily launch a project and receive bids from qualified experts.

  • Workflow Management: Brands can manage the entire workflow from a single dashboard with built-in messaging, real-time updates, and secure payments.

• Retailers

  • API Integration for Fit & Alterations: Retailers may use Seamsdress to offer post-purchase alteration services via API, enhancing customer experience and reducing returns. This includes allowing shoppers to import saved measurements, match them to retailer size charts for accurate fit recommendations, and instantly connect to a local provider through our national directory if tailoring is needed.

  • Transparency & Disclosure: Retailers must clearly disclose that tailoring is provided by independent providers, not by Seamsdress or the retail brand.

  • Ethical API Usage: Retailers must use measurement and sizing integrations ethically and in compliance with Seamsdress's API terms.

Community Conduct

You agree to behave respectfully, professionally, and lawfully in all interactions. Violations of this agreement, including community conduct expectations, may result in immediate removal from the platform, account suspension, or permanent banning.

a. Respectful Behavior

• No harassment, hate speech, bullying, vulgarity, or threats

• Treat all users with dignity regardless of background, identity, or experience
   

b. Confidentiality

• Do not share private details about others without explicit consent
   

c. Identity

• No false identities, impersonation, or misleading profile info
   

d. Group, Forum, Feed & Messaging Use

• Follow all posted group rules

• Content must be relevant, respectful, and not promotional unless explicitly permitted

• Do not misuse groups, forums, feeds, or messaging to promote competing services, solicit off-platform engagement, or recruit for other businesses or networks
   

Use of Messaging & Community Features
You may engage other users through Seamsdress’s messaging, forums, and group features. However, you may not:

• Use these features to cross-sell or promote services that compete with Seamsdress

• Build off-platform businesses, networks, or projects using contacts gained here

• Share external links or contact information for the purpose of bypassing Seamsdress’s payment, bidding, or communication systems

• Coordinate projects outside the platform
   

Violation of this agreement—including this section—may result in immediate removal from the platform, account suspension, or permanent banning.
 
User Content and Intellectual Property

You retain ownership of your content but grant Seamsdress a non-exclusive, worldwide, royalty-free license to use, display, and distribute it for platform purposes.

You may not upload:
 

• Content you don’t own or lack rights to use

• Malicious, misleading, or offensive content
   

Monitoring and Moderation

Seamsdress may:
 

• Monitor platform activity

• Remove or restrict content

• Suspend or terminate accounts for any reason

• Disable or limit accounts impersonating others or engaging in fraudulent or deceptive behavio

 
 API Integration Terms

Retailers may integrate Seamsdress into their website or store via approved apps or API. Your use of our API is subject to the following terms and restrictions:
 

• Authorized Use Includes:

  • Fetching customer measurement data with their consent.

  • Mapping Seamsdress measurements to retailer size charts to generate recommendations.

  • Displaying local Seamsdress service providers for customer alterations.

  • Integrating secure payment flows consistent with Seamsdress's payment processing methods.

• Prohibited Use Includes:

  • Caching or storing measurement data long-term without explicit customer consent.

  • Making automated queries that degrade platform performance.

  • Misrepresenting the nature of Seamsdress services (i.e., implying tailoring is done in-house).

  • Using Seamsdress data to train external models, systems, or tools without express permission.

  • Any other use that violates applicable laws, regulations, or privacy policies.
     

Seamsdress reserves the right to audit, restrict, or revoke API access at any time.
 
Seamsdress Shopify and Wix Apps

Seamsdress offers "Smarter Sizing. Seamless Fit." applications specifically designed for integration with Shopify and Wix eCommerce platforms. These apps, along with our public API, make it easy for eCommerce brands to offer precise, personalized fit experiences directly on their websites.
 

• For Customers: These apps allow customers to securely pull their saved Seamsdress measurements in just one click. The app then automatically compares these body measurements to product size charts to recommend the best size, aiming to eliminate guesswork. If alterations are needed, customers can instantly connect to a local provider from the national Seamsdress Directory—including tailors, designers, or manufacturers—for the perfect fit. The goal is "No more guessing sizes or wasting time on returns—get the right fit, right away."

• For Brands/Retailers: By integrating these apps, brands and retailers can cut returns, increase conversions, and provide their customers with a fit experience they’ll trust.

• For Tailors & Designers: These apps also contribute to the visibility of tailors and designers listed in the Seamsdress directory, helping them generate new leads and grow their business as part of a national network.

 
Seamsdress Sizing Tools - Limitation of Liability and Returns

Seamsdress provides its sizing apps and API as technology tools designed to assist eCommerce brands in offering personalized fit experiences.
Important Disclaimer and Strict Limitation of Liability: While Seamsdress strives to enhance the shopping experience through its sizing tools, it is crucial to understand and acknowledge the inherent limitations and the allocation of responsibility. Seamsdress provides software solutions; we do not perform physical measurements, provide direct tailoring services, or manufacture garments.

Therefore:
 

• No Guarantee of Fit or Accuracy: Seamsdress does not verify, warrant, or guarantee the absolute accuracy, completeness, or suitability of any size recommendations generated by our apps or API integrations. These recommendations are algorithm-based suggestions derived from data input and are not a substitute for professional fitting or personal judgment.

• No Liability for Sizing Discrepancies or Returns: Seamsdress shall not be held legally liable or responsible for any sizing discrepancies, fit issues, dissatisfaction, or the ultimate suitability of an item that a customer receives, even if a size recommendation was generated or a tailor connection was made using Seamsdress sizing tools, apps, or API data. This includes, but is not limited to, any direct, indirect, incidental, consequential, special, or punitive damages arising from a customer receiving an item that does not fit.

• No Responsibility for Tailoring Outcomes: Seamsdress is not responsible for the quality, accuracy, timeliness, or outcome of any tailoring or alteration services performed by independent third-party service providers connected via our directory, even if the connection was facilitated by the Seamsdress sizing app or API. Any issues arising from tailoring services must be resolved directly between the customer and the service provider.

• Retailer and Customer Responsibility:

  • Customers acknowledge and agree that size recommendations are advisory in nature and depend heavily on the accuracy of the measurements they provide and the precision of the retailer's size charts. Customers bear the sole responsibility for making final purchasing decisions. The promise of "no more guessing sizes or wasting time on returns" refers to the potential benefit of using the app but does not create a guarantee from Seamsdress.

  • Retailers acknowledge and agree that while the Seamsdress Apps and API are designed to "Cut returns, increase conversions, and give your customers a fit experience they’ll trust," Seamsdress makes no explicit or implied warranties regarding a specific reduction in return rates or an increase in conversions. Retailers are solely responsible for the products they sell, their own size charts, and their return policies.

• Data Integrity: The effectiveness of our sizing tools is directly contingent upon the accuracy and completeness of the body measurements and product size chart data provided by customers and retailers, respectively. Seamsdress is not responsible for errors or omissions in such input data.

By utilizing Seamsdress's apps and API for sizing, customers and retailers explicitly accept these limitations of liability and understand that Seamsdress's role is strictly that of a technology platform provider.
 
Payments, Stripe Integration & Fees

All financial transactions are processed by Stripe.
 

• Customer Payments: Customers pay through Seamsdress when accepting bids.

• Secure Fund Holding: Funds are held securely and released to the provider once milestones are completed or final approval is given.

• Provider Payouts: Providers must connect a Stripe account via their admin dashboard to receive payments.

• Fees:

  • Stripe Processing Fee: 2.9%+$0.30 per transaction (subject to Stripe's terms).

  • Seamsdress Platform Fee: 5% of the transaction amount on payments under $1,000. For transactions over $1,000, specific tiered fees may apply, as detailed within your provider dashboard.

  • Automatic Deduction: Fees are deducted automatically before payout.

  • Transparency: All transaction details are visible in your dashboard.

 
Communication & Project Management

All communication related to projects must occur via the Seamsdress platform.

• Prohibited Circumvention: Using external messaging tools to circumvent platform protections is prohibited and may result in account removal.

• Project Milestones: The platform supports the establishment and tracking of project milestones, facilitating a structured and managed workflow for complex projects.

 
Platform Limitations & Disclaimer

Seamsdress provides software tools for connecting and coordinating services. We do not guarantee the quality, safety, legality, or timeliness of work delivered by providers.
 

• Specifically:

  • We do not verify the accuracy of size recommendations or tailoring outcomes from API integrations.

  • We are not responsible for service contracts, delays, dissatisfaction, or disputes between users.

  • Customers and providers assume all liability related to the delivery and outcome of services.

 
Data, Security & Consent

All user-submitted data (e.g., measurements, photos, messages, preferences) is governed by our [Privacy Policy].
 

• Data Usage: Seamsdress only uses customer data for the purposes of facilitating services, payments, and platform improvements.

• Secure Transmission of Measurement Data: Measurement data used by retailers via our API is transmitted securely and may only be accessed with user consent.

• No Sale or Unauthorized Sharing: Seamsdress does not sell or share personally identifiable information with unauthorized third parties.

• Security Measures: Seamsdress employs reasonable technical and organizational measures to protect user data from unauthorized access, alteration, disclosure, or destruction. However, no internet transmission or electronic storage is entirely secure, and we cannot guarantee absolute security.
   

Users are responsible for ensuring files are safe and virus-free.

Seamsdress is not liable for:
 

• Loss of data

• Malware or technical damage
   

Indemnification

You agree to indemnify and hold harmless Seamsdress and its affiliates from any claims, losses, or liabilities resulting from your use of the platform or violation of this agreement.

Platform Availability

We do not guarantee uninterrupted service. Downtime may occur for maintenance or technical issues.
 
Non-Solicitation Clause

You may not solicit Seamsdress users for competing services outside the platform during active use and for 12 months after your last interaction. This includes direct and indirect solicitation via private messages, forums, or groups.

Note: This clause may be limited by applicable local laws.
 
Disputes Between Users

Seamsdress is not responsible for disputes between users. We may intervene at our discretion but encourage users to resolve issues independently. Users acknowledge that Seamsdress is not a mediator or legal party in user disputes.
 
Termination of Access

We may suspend or delete your account at any time for violating these terms, with or without notice. Termination may include content removal, account restrictions, and full access revocation. We reserve the right to prohibit re-registration of banned accounts.
 
Legal Compliance & Jurisdiction

Seamsdress is registered in Arizona, USA, and this Agreement is governed by the laws of the State of Arizona and the United States. By using Seamsdress, you agree to comply with all applicable federal, state, and local laws related to online conduct, commerce, education, financial activity, digital communication, and intellectual property. You further agree not to pursue legal claims based on state-specific statutes that conflict with the terms of this Agreement unless those claims are explicitly protected by federal law.  You waive the right to bring claims under individual state laws that conflict with or bypass this Agreement. Disputes shall be resolved in the courts of Arizona unless otherwise required by U.S. federal law.
If any part of this agreement is found unenforceable, the rest remains in effect.

By using this platform, all users—including those in other U.S. states—agree:
 

• To waive the application of state-level commercial or consumer protection laws that conflict with these Terms.

• To resolve any disputes exclusively through arbitration or courts located in Arizona.

• That Seamsdress is not liable for legal claims originating outside of platform usage or for off-platform transactions.

 
Enforcement & Termination

Seamsdress reserves the right to suspend or permanently ban any user who:
 

• Violates these Terms.

• Engages in fraud or abuse.

• Attempts to manipulate platform payments or messaging.

• Provides low-quality or harmful service.
   

Modifications and Notice

We may update this Agreement periodically. Users will be notified of material changes via email or in-app banners. Continued use constitutes acceptance.
 
Support and Reporting

For issues or to report violations, email support@seamsdress.com or use in-app reporting tools. We respond to all complaints and may issue warnings, suspensions, or permanent bans.
 
Agreement Version Control

Updates will be reflected in future version numbers and effective dates.
 
Enforcement and Violations

Violation of this Agreement—or any specific section herein—may result in:
 

• Immediate removal from the platform
   

• Temporary or permanent account suspension
   

• Deletion of user content or profile data
   

• Prohibition from re-registration
   

• Referral to legal authorities where applicable
   

Seamsdress reserves the right to enforce this policy at its sole discretion.

No Reliance

Users acknowledge that any information, advice, content, or communication provided through the platform (including community posts, forum discussions, or messages) is for informational purposes only. Seamsdress does not endorse, verify, or warrant the accuracy or reliability of user-generated content, and users agree not to rely on it as legal, financial, professional, or personal advice.

International Use and Export Compliance

Seamsdress is operated from the United States and intended for U.S. users. If you access the platform from outside the U.S., you do so at your own risk and are responsible for compliance with your local laws. You agree not to use Seamsdress for any purpose prohibited under U.S. export control laws, including sharing content restricted by government regulation.

Dispute Resolution and Class Action Waiver

To the fullest extent permitted by law, you agree that any dispute with Seamsdress will be resolved individually and not as part of any class action or representative proceeding. You waive your right to participate in any class, collective, or mass action or arbitration. We reserve the right to require binding arbitration under commercially reasonable rules if permitted by applicable law.

Prohibited Business Use

You may not use Seamsdress to develop, train, or solicit for a competing product, service, software, database, or marketplace. Any attempt to copy or reverse-engineer the platform’s structure, workflows, business model, or community for commercial purposes is strictly prohibited and may result in immediate legal action.

Acceptance of Terms

By proceeding with account creation or platform access, you confirm electronically that you have read, understood, and agreed to the Seamsdress Terms of Service.

You further acknowledge that this Agreement may be updated periodically. Your continued use of the Seamsdress platform after any posted updates constitutes your acceptance of the revised terms, whether or not you are prompted to re-consent.

Violation of this agreement—including any provision above—may result in immediate account removal, loss of access, withheld funds, or permanent banning.
